2. Prohibited Activities
The following activities are strictly prohibited and may result in immediate account termination and legal action:
- Spam & Abuse: Mass-emailing campaigns, unsolicited bulk messaging, or sending more than 100 emails per day. Hosting webpages advertised via spam emails is strictly forbidden.
- Illegal Content: Hosting pornography, torrents, or any illegal materials.
- Malware & Security Threats: Hosting viruses, worms, trojans, keyloggers, or any malicious software.
- Network Attacks: DDoS attacks, floods, stress-testing, port scanning, vulnerability scanning, brute forcing, or any method intended to cause denial of service.
- Cryptocurrency Mining: Unauthorized cryptocurrency mining or mining pools using our infrastructure.
- Proxy & Tunneling Services: Operating open proxies, GRE tunnels, UDP fragmentation, or TOR exit nodes.
- Botnets & Remote Administration: Hosting botnet controllers, command and control servers, or remote administration software.
- Hacking & Exploitation: Red teaming, penetration testing, exploits, IP spoofing, or any hacking/cracking activities.
- Phishing & Fraud: Hosting phishing websites, fake/replica product websites, deceptive marketing, or HYIP/ICO schemes.
- Gambling & Financial Services: Hosting gambling websites or offering unlicensed financial services.
- Copyright Violation: Hosting copyrighted materials without proper authorization.
- Illegal Content Forums: Hosting websites discussing hacking, carding, or other illegal activities.
- Hate Speech: Hosting content promoting antisemitism or any form of hate speech.
- Fake News & Misinformation: Hosting fake news websites or giveaway scam sites.
- Security Vulnerabilities: Operating open DNS resolvers or applications vulnerable to DDoS amplification attacks.
- Blacklisted IPs: Using IPs blacklisted by RBLs, antivirus software, or security companies.
3. Account Responsibility & Security
You are entirely responsible for:
- Maintaining the confidentiality of your account credentials and passwords
- All activity conducted under your account, regardless of who performed the action
- Notifying us immediately of any unauthorized access or security breaches
- Complying with all applicable laws and regulations in your jurisdiction
- Regular backups of your data (we are not responsible for data loss)
- Using strong, unique passwords and enabling two-factor authentication where available
4. Service Suspension & Termination
We reserve the right to immediately suspend or terminate your account and services without notice if:
- You violate any of these Terms and Conditions
- Your account is used for prohibited activities
- You fail to pay invoices by the due date
- Your activity causes harm to our infrastructure or other customers
- We receive legal requests or court orders regarding your account
- Your IP address is blacklisted by security organizations
Upon termination, you forfeit all service credits and have no claim to refunds, regardless of the reason for termination.
5. Payment & Billing
Payment Terms:
- Services are billed on a pre-paid basis according to your selected plan
- All fees include applicable taxes unless explicitly stated otherwise
- Invoices are due by the specified due date on the invoice
- Late payments may result in service suspension after a 7-day grace period
- Continuous non-payment may result in permanent account termination
- No refunds are provided for services already rendered
- We accept major credit cards and may accept other payment methods at our discretion
6. Service Level & Performance
While we strive to maintain high uptime standards, services are provided "as-is". We do not guarantee:
- Continuous, uninterrupted service availability
- Specific performance levels or response times
- Error-free operation or software/hardware functionality
- Protection against data loss from any cause
Scheduled maintenance may occur without advance notice. We will attempt to notify users of significant maintenance windows in advance.
7. Limitation of Liability
A1Vps and its officers, directors, employees, and agents shall not be liable for:
- Any data loss, corruption, or accidental deletion
- Service downtime or inability to access your account
- Any indirect, consequential, incidental, or punitive damages
- Loss of revenue, profits, or business opportunities
- Damages caused by third-party services or content
- Security breaches due to user negligence or weak passwords
- Any damages resulting from your use or misuse of our services
Our total liability is limited to the amount you paid for services in the 30 days preceding the incident.
8. Intellectual Property Rights
All content, design, functionality, and intellectual property related to A1Vps services remain our exclusive property. You retain ownership of content you upload, but grant us the right to use it as necessary to provide services. You may not reverse engineer, decompile, or attempt to gain unauthorized access to our systems.
9. Third-Party Content & Services
We are not responsible for:
- Third-party services or content linked to our platform
- Accuracy, legality, or appropriateness of external content
- Issues arising from third-party software or integrations
Your interaction with third parties is solely your responsibility.
10. Monitoring & Compliance
We reserve the right to:
- Monitor account activity for security, compliance, and abuse prevention
- Access your account to investigate violations of these terms
- Cooperate with law enforcement and legal authorities
- Block or remove content that violates these terms
- Report suspicious activity to relevant authorities
11. Governing Law
These Terms and Conditions are governed by and construed in accordance with applicable local and international laws. Any legal action must be filed in the appropriate jurisdiction as determined by A1Vps.
